Half Rights?
"We hear the phrase 'Islam grants women half rights' frequently from both critics of Islam and some Muslims. But is this claim truly what the Quran states, or is it a disjointed interpretation of a verse?
This article aims to promote a holistic reading of the inheritance verses, to understand the historical context, and to question madhhab rigidity.
Pre-Quranic Arab Women
To understand the inheritance verses, it is essential to know the society in which the Quran was revealed:
- Women could not inherit. Women were the objects of inheritance; upon a man's death, women were "inherited" like property.
- Girls were buried alive (Surah At-Takwir 81:8-9).
- Women had no economic rights. Rights such as acquiring property and engaging in trade belonged to men.
The Quran was revealed in this environment. And it made a revolution.
The Quran's Inheritance Revolution (Surah An-Nisâ 4:7-12)
What the Verses Say
Verses 11-12 of Surah An-Nisâ lay the foundation of Islamic inheritance law. The critical ruling is as follows:
"Allah commands you regarding your children’s inheritance: for the male, what is equal to the share of two females."
This sentence is often where the discussion ends. But the continuation is overlooked:
- If the deceased has only daughters → they receive two-thirds of the inheritance (Surah An-Nisâ 4:11).
- If the deceased has only one daughter → she receives half of the inheritance (Surah An-Nisâ 4:11).
- The mother receives one-sixth in all cases (Surah An-Nisâ 4:11).
- The wife (woman), if there are no children, receives one-fourth (Surah An-Nisâ 4:12).
Mathematical Reality
Islamic law professor Muhammed Shahrur found the following when analyzing the inheritance shares in the Quran:
- More than 30 inheritance scenarios can be derived from the Quran.
- In only 4 of these does a woman receive half of what a man receives.
- In more than 10 scenarios, women receive equal to or more than men.
- In some scenarios, women receive twice what men receive.
Revolutionary Perspective

The transition from zero to any share is a revolution. To belittle this as "half" is to overlook the revolution.
Why the 2:1 Ratio in Some Cases?
In 7th-century Arab society:
- The man bore the entire financial burden of the family.
- Mahr (dowry) was paid by the man to the woman.
- Nafaqa — housing, food, clothing — was entirely the man's responsibility.
- A woman's property belonged to her; she had no obligation to spend.
Thus, a man received 2 units but spent 1.5 units on the family. A woman received 1 unit, and all of it remained with her. The net result: women had more in their hands.
Freezing the Text Kills the Spirit
The issue lies not in the Quran, but in the rigidity of madhhabs that freeze the literal text of the verses rather than their spirit:
- Hanafi/Shafi'i: Applied the 2:1 ratio as an absolute rule.
- Yet the verse was responding to economic conditions specific to a period.
- Today, women work, pay taxes, and share financial responsibilities.
- Freezing the text kills the spirit of the verse aimed at justice.
Fazlur Rahman conceptualizes this as "double movement": First, understand the context in which the verse was revealed, then carry the principle it embodies into today (Islam and Modernity).
Where Does the Spirit of the Verse Point?
The Quran aims for the principle of justice when determining inheritance shares:
"O you who have believed! Be persistently standing firm in justice, witnesses in justice, even if it be against yourselves or parents and relatives." — Surah An-Nisâ 4:135
Justice was achieved in the 7th century with the 2:1 ratio — because women received nothing. Today, justice can be achieved with equal shares — because economic conditions have changed.
Freezing the literal text of the verse nullifies the justice the verse aims for.
To Our Mothers and Sisters
While writing this article, we taught ourselves. We did not know that in only 4 out of 30+ inheritance scenarios the 2:1 ratio applied. We did not see the revolutionary nature of the transition from zero to a share. We learned that the spirit of the verse is justice, and its literal text cannot be frozen — by reading this.
We do not tell anyone to "think this way." But we asked ourselves: Is copying the economic conditions of the 7th century into the 21st century the justice the verse seeks?
We are the mirror of the universe. Our understanding of justice is the universe's understanding of justice. If we learn ourselves — everyone learns.
